Deepinder Goyal-led food delivery giant Zomatois now facing an insolvency plea filed by uniform supplier Nona Lifestyle, which claims the food delivery platform owes Rs 1.64 crore in unpaid dues.

According to a Bar & Bench report, The National Company Law Tribunal (NCLT) has adjourned the case to April 3, requesting the petitioner to clarify its next steps.

Non-payment of multiple orders

The report said that Nona Lifestyle, a B2B apparel manufacturer, initiated the corporate insolvency resolution process (CIRP) over alleged non-payment for multiple orders placed by Zomato in 2023. The disputed items include rider uniforms, trousers, and ICC World Cup 2023 merchandise.

Nona Lifestyle claims Zomato delayed payments and refused to accept deliveries, citing storage constraints.

The company further claims that Zomato used "threats and warnings" to pressure it into offering discounts and ultimately refused to accept the remaining World Cup jerseys, citing a "failed" campaign—despite the jerseys being custom-made and unsuitable for other use..

What did Zomato say?

Zomato, meanwhile, has denied the allegations. The company contends that Nona Lifestyle repeatedly missed agreed-upon delivery deadlines, incurring penalties under the terms of their contract.

The food delivery giant argues that these delays caused reputational and goodwill damage and maintains that it only paid for delivered jerseys after deducting penalties and adjusting the advance payment.

Recently, Ola Electric Technologies, a wholly owned subsidiary of electric two-wheeler maker Ola Electric, also reportedly faced an insolvency plea over alleged non-payment of Rs 18-20 crore in dues, according to a report.

Rosmerta Digital Services, an operational creditor, filed a petition before the Bengaluru bench of the National Company Law Tribunal (NCLT), seeking to initiate a corporate insolvency resolution process (CIRP) against the company.

The plea alleges that Ola Electric Technologies failed to pay for services rendered. In response, Ola Electric has disputed the claims and plans to challenge the petition through legal proceedings.
