According to Mohith’s petition, on December 22 of last year, he contacted Decathlon regarding the purchase of Forclaz Trekking Trousers MT-500. He was informed that the product was available only at Decathlon’s store in Bengaluru's ETA Mall.
The company's representatives instructed him to make the payment online and assured him that the trousers would be delivered to his address.
Mohith had paid Rs 1,399 online for the trekking trousers but never received the product. When he inquired with the staff at Decathlon's ETA Mall store, he was informed that the item was missing.
During a visit to the store on February 6, Mohith was assured that a refund would be processed. However, despite multiple follow-up calls on February 10 and 13, no refund was issued.
Mohith then sent a legal notice to the company on April 9. In response, Decathlon informed him that the ETA Mall store had closed, leaving his request unaddressed.
Approaching consumer court
Frustrated by the lack of resolution, Mohith took the matter to the consumer court, which subsequently issued notices to Decathlon.
In the ruling issued on Tuesday, Somashekarappa Handigola, the president of the consumer court, ordered the company to reimburse Mohith Rs 1,399 for the trousers, Rs 25,000 for the deficiency in service, and an additional Rs 10,000 to cover litigation costs.
Recently, Decathlon announced its partnership with Aadit Palicha-led Zepto for 10-minutes delivery of sports equipment and other items.
